Modibo Diarra :: essays research papers
Modibo Diarra is one of the toughest players you can meet on a basketball court. Off the court, he is soft-spoken and extremely friendly. When you first meet him you can not help but want to be friends with him. I had the opportunity to first see Modibo play this past summer at an AAU (Amateur Athletic Union) event. On the court any professional scout in America (including myself) will tell you that come next year Modibo will have the luxury to pick whatever school he wants. He is that talented and that special of a player. Still, there is something about Modibo off the court that makes him such a terrific human being. At a recent hoop tournament that I was covering, I was amazed to see how much excitement there was when Modibo stepped onto the court. At first, I thought well, everybody in the gym must be here to see this extraordinary 6'9" shot blocker perform. It is true a lot of people did want to see him perform on the court, but there is a different type of fan cheering whe n Modibo is out there. Friends close to him will tell you that Modibo has a following in and around Boston. People who don't even follow basketball still go to games and watch him play just because they met him and hope he succeeds. Modibo is some one special He has a gift on and off the court. Modibo is no stranger to basketball. In his home country in Mali, Africa he was able to catch a glimpse of USA basketball through satellite. Just like any kid in America who has dreams of making it to the NBA, kids in Africa do have that dream as well. They have goals of being successful in life and taking care of their family. When a down and out coach from American University was trying to recruit another player to come to his school, that player decided on playing European ball instead. Scott Spinelli saw a pickup game going on near by, so to ease off his disapointment he stuck around to watch. What he found was were kids playing on a dirt ground, wearing sandals and some just playing on barefeet. Scott saw a young 6'9" kid who swatting every basket in sight and immediately thought this kid has potential written all over him. After staying in Africa for a couple of weeks and convincing Modibo's father and two wives that it was alright for Modibo to go to the United St ates and play basketball, good luck took a major hit. Legal Studies – the Family Law Amendment (Shared Responsibility) Act 2006
The Family Law Amendment (Shared Responsibility) Act 2006 commenced on the first of July 2006 assists in the way that separating parents resolve their disputes involving the best interests of their children. This law is still taking time to make an effect on divorcing and separating parents, as sources show that shared custody arrangements or 50:50 joint custody makes little effect on the children involved in these situations. This was achieved through a major study conducted by Bruce Smyth and Bryan Rodgers who showed that children in shared care are no worse off or no better than those who see the other parent every second weekend for example [Source E]. The aim of the legislation was to change the past 1995 reforms as they failed to achieve the desired impact of separating couples [source A]. The act was created also to encourage parents to share the parenting of their children by allowing them to have equal time with both mother and father and also for the major decisions and responsibilities of the children to be distributed evenly. The law was changed because of the various groups who protested against the past regulations the law provided. The changes included the terminology, facilitation of shared parenting time and the concept that the separated parents both retain parental responsibility [Source A]. The new family law process outlined in the Every Picture Tells a Story report also creates an emphasis on parents coming to agreements in a ââ¬Ëparenting planââ¬â¢. There was also a proposal to create a ââ¬ËFamily Tribunalââ¬â¢, which was where the separating parents could work their issues with consultation and counseling without the invasive use of the courts. The government also put forward $400 million to be spent on 65 family relationship centres for counseling couples [Source B]. Groups who have been against the Family Law Amendment are law academics, judges, womenââ¬â¢s legal services, and single mother groups, [source D] because of the issue of abuse from their spouses after the separation. The act sets out that parents are to share the responsibility of the children between them, with the exclusion of abusive spouses. This therefore results in parents having to consult each other about their childrenââ¬â¢s education, religious and cultural upbringing, health, change of name, and also place of residence [Source A]. Also included in the act is that counseling would be offered to parents in assisting them to reach an agreement between both parties, and child support doesnââ¬â¢t have to be given until six weeks after the parents have separated. The Act only previously allowing grandparents contact through applications however rights have been elevated and the relationship between the children and grandparents are taken directly into consideration when making the arrangements in the parenting plan. The presumption of equal shared responsibility in the amendment means that both parents have an equal role in making decisions about the major choices involving the children; for example what school they will attend. The presumption however does not apply to a parent who has engaged in any abuse, violence or neglect towards the child, and was not included in the previous Act. With this the Act strives to provide the parents with equal shared responsibility which means the child spends a reasonably even amount of time with each parent (if it is in the best interest of the child). The main issue of the legislation is the increase in funding necessary for the Act to go ahead, as the proposals put forward for the committee, family centres, and other programs require a great deal of money to be established. Tax payers are forced to contribute more so that these can be provided, however in saying this establishing the inquisitorial tribunal creates a more level playing field for separating partners, particularly if one party cannot afford private legal representation [Source A]. In excluding legal representation, which is what happens in this process, creates a lesser need for lawyers to be involved in family matters, therefore those representing families will no longer be needed. According to the National Association of Community Legal Centres they suggest that the new family law and processes ââ¬Å"may be harmful to childrenâ⬠[Source B]. Compulsory mediation may force separated parents to communicate and associate with their former abusive partners, who may blackmail or force that parent to agree to an arrangement that benefits the abuser. This leads to a lifetime of fear and anticipation of more abusive from the former partner. According to the legislation, if a report or suspicion of abuse has arisen, the mediation will not go forward nor will it agree to unsafe parenting arrangements. While some children benefit from the equal shared parenting arrangements, it doesnââ¬â¢t mean that some are better or worse off than others. Joint physical custody has been found to be workable only in a minority of separations where parents have freely chosen the arrangement. The cases in which the shared parenting has generally worked is when there is no record of abuse or conflict and when there is commitment from both parents. [Source C]. Throughout this whole process the mediation is voluntary, and can stop at any time as the couples wish. The parties have access to legal advice, either during the mediation or before signing any mediated agreement [Source B]. There are many financial problems with this Act, as separated parents have to pay for the children independently and cannot find stability with their finances in order to pay for schooling, health and so forth. There is also the major issue that is domestic violence. The Act reinforced a fine for making false allegations about abuse and therefore some parents were pressured into making parental agreements that involved the abuser. This also made some victims too scared to tell courts about abuse or violence directed at their children [Source F]. This law is affective, however could be revised in order to benefit the parents. The financial problems that are caused by this law are unavoidable for some families, as one parent or both may struggle to afford to make ends meet. The court could evaluate each parentââ¬â¢s financial status and the ability of them to be economically safe in order to enable them to be able to raise the children effectively. However in saying this, the court should not take children off one parent if they are not capable to pay for the child, especially if the other parent is reportedly an abuser. Abusive parents should be constantly monitored whilst mediating with the other parent (if the victim wants mediation) and the child should have a say in which parent they think is able to look after them. Abusive spouses should not be allowed any contact with the victim while proceedings are happening, so that they do not coerce the other parent into an unfair parenting agreement. The abused parent should also be supervised during this period so that it is seen that they are not influenced or blackmailed by the abuser. The Act should focus more on the childââ¬â¢s need than the parents. While both parents have equal shared responsibility, the child should be involved in the parenting agreements and have a fair say in what happens to them. It is argued that the Act focuses more on the parentââ¬â¢s rights than the childrenââ¬â¢s needs, and that the reforms favor fathers more than mothers [Source F]. In conclusion, it is believed that the Act is not effective however has improved the rights of equal responsibility between parents. It is said that shared care is proving successful for many parents, [Source E] however parents are the only beneficiaries from this because the arrangement aids them more than the child, as the Act is more in the parents favor than the childrenââ¬â¢s. The Act should be revaluated so that it is beneficial to all parties.

Foreign Direct Investment Essay
The main purpose or objective doing this report is 1. To study what is actually Foreign Direct Investment (FDI) and their types. 2. To study the FDI trends and how it influences to India 3. To study the advantages and disadvantages also importance FDI to India and their investors itself. 2. Introduction Foreign Direct Investment (FDI) is capital provided by a foreign direct investor, either directly or through other related enterprises, where the foreign investor is directly involved in the management of the enterprise. According to International Monetary Fund (IMF, International Monetary Fund, 2013), Foreign Direct Investment or simply as FDI refers to an investment made to acquire lasting or long term interest in enterprises operating outside of the economy of the investors. It can simply define as the allocation by a multinational firm of capital, managerial and technical asset from its home country to a host country. In FDI it had three components whereas: equity capital, reinvested earning and intra-company loans. Inflows of FDI stated as a net basis meanwhile outflow of FDI is the reporting economy comprise capital provided by a firm from host country. There were several types of foreign direct investment which is Multinational Corporation, transnational corporation, strategic alliance, and also joint venture. For Multinational Corporation it was operate or handling from their home country even it actually operating in several country. The transnational corporation is the country that maintains the significant operation in more than one country but regionalize management to the local country. Meanwhile the strategic alliances was an approach to going global that involve partnership between an organization and a foreign company in which both share knowledge and resources in developing new products or building production facilities. It was common place in the biotechnology, information technology and the software industries. The joint venture FDI is an approach to going global that is specific types of strategic alliance. There was the partner had agreed to form an independent organization for some business purpose. For the joint venture types is divided into two types hich is contractual joint venture and equity joint venture. The contractual joint venture was between firms usually for a specific project, such as manufacturing a component or other product for a fixed period time. Meanwhile the equity joint venture was when a firm holds an equity stake in the setting up the joint subsidiary such as produce goods or services. 3. History of FDI in India It is false if people advocated that India is a fresh country joining foreign direct investment (FDI). It is totally wrong. Actually India already joined or more accurate received the FDI since 1947, more early than other countries (Kapur, 2005). It was concentrated in primary sectors and services whereas foreign country like British conquers Indiaââ¬â¢s mining, plantations, trade and manufacturing base. In early post-Independent years, FDI contributed and shows significant role as India turned abroad for both technology and capital. Late 1950s, foreign capital was invited in various sectors by Indian government (Kapur, 2005). The sectors was pharmaceutical drugs, aluminum, heavy electrical and chemicals. The results, during the 1960s, the capital flow concentrated on manufacturing especially technology-intensive industries. End of 1960 approximately 60 percent capital from FDI flows to manufacturing industries. Reverberation from food crisis and depreciation of the Rupee in 1960, the hardening of policy was there. Early 1970, foreign oil majors were publicly owned. The government of India never rules out the new foreign investment but now it wanted to be in restrictive term. In 1973, the Foreign Exchange Regulation Act (FERA) had introduced an article that obligatory firms to dilute their foreign equity holdings to 40 percent if they wanted to treat as like Indian companies. By the mid-1980, growing concern about stagnation and technological uselessness in India industry led to push for economic reform and deregulation (Kapur, 2005). On the 1990s, it started with major crisis. In the middle of Gulf War, and the consequent removal of Indian emigrant from the Middle East, foreign exchange payments fell. The panicked withdrawal of funds happened in India by Non Resident that occurred not balance of payments. As agreed with the IMF, the Rupee was devalued, and the fresh attempts were made. That will to liberalize the trade rule and the guiding framework.

Bury My Heart at Wounded Knee Book Report essays
Bury My Heart at Wounded Knee Book Report essays One of the two books I read over the summer was Bury My Heart at Wounded Knee by Dee Brown. This book used council records, autobiographies, and firsthand descriptions to illustrate the destruction of the American Indian tribes between the years of 1860 and 1890. Chapter one, titled Their Manners Are Decorous and Praiseworthy, elaborates on the events following the meeting of the white settlers and the American Indians. When Columbus first came across the Indians, he described them as tractable and peaceable. The Europeans decided that they were superior to the Indians, and that because the Indians were inferior they should adopt the European ways. Whether the Indians wanted to change or not was of little importance to the settlers, as European ways of life were forced on them. Andrew Jackson, who took office in 1829, recommended that the Indians should be separated from the white settlers as the two could not live in peace together. The Indians would be moved to a permanent Indian frontier west of the Mississippi River. This recommendation became law two years later. However, new settlers had already began settling in Wisconsin and Iowa. So the permanent Indian frontier had to be moved from the Mississippi to the 95th Meridian. A Navaho by the name of Manuelito and other leaders of his tribe had made peaceful treaties with the Americans. Then the Americans decided to build a fort on Navaho land. The Indians and whites lived peaceably for some time, until soldiers burned Navaho hogans and killed their livestock because of some reckless Navaho youths. This angered Manuelito, as he had kept every promise on his side that he had made in the many treaties with the settlers. The Navahos had been a wealthy tribe, but constant attacks on their villages made them extremely poor. The Navahos lost many horses and mules from the...

How Did the Age of Enlightenment Influence Western Civilization
How Did the Age of Enlightenment Influence Western Civilization Introduction From the past, the center of attention for those in leadership tends to be on power and control. However, great thinkers in the past came to appreciate that it would be very beneficial if the government was to be inclined to peopleââ¬â¢s interest as opposed to the personal interests of its leader.Advertising We will write a custom research paper sample on How Did the Age of Enlightenment Influence Western Civilization specifically for you for only $16.05 $11/page Learn More This new view of life was only possible due to the philosophers present in European enlightenment. This period began in 1600 to 1800 A.D. and is the age of enlightenment. This is because it is considered as the period that led to contemporary philosophical thought. It consists of the age of reason beginning 1600 to 1700 A.D. when Europeans struggled to free their minds from being control by both state and church leaders. The struggle took place in different sectors such as religion, where leaders wanted to be free to develop knowledge about God and man relationship. There was also struggle between citizens and the government, where citizens viewed government abuses as interfering with the inherent rights of the people. The period from 1700 to 1800 A.D is The Enlightenment. In the period, citizens were highly exploited by the ruling elites. They faced problems such as unemployment, starvation, and disease world over. Many people rose up in this period to resist this kind of oppression. Philosophers in these periods applied reason in attacking religious extremism, intolerance, and superstition, things that they viewed as obstacles to development of freethinking. Consequently, enlightenment had influence in almost all areas including politics, economy, religion, and social. Discussion Influence on Religion The period led to transformation in religious beliefs by many people. While previous scholars were concerned with religious questions on organization of the church, the new philosophers were interested in role of individualââ¬â¢s in the society as well as in secular study of society. They criticized the church because it exerted great pressures on society. For instance, the manner in which the church charged taxes to peasants. In addition, the ruling elite considered the church as important for building a better government and society. However, by accepting reasoning as a way of explaining various sides of human life, different types of people including deists and atheists emerged. Atheists consists of a group of people who do not subscribe to any religious believe, while the deist are believers in God but do not consider him to be in control of what happens in the world. Some of the deist like Voltaire considered Christianity as the main cause of fanaticism and oppression to humanity. Enlightenment therefore made leaders to develop some form of tolerance in religious differences.Advertising Looking for research paper on ancient history? Let's see if we can help you! His escape and new life in England made him an admirer of the new country, especially because of its press freedom, religious tolerance and political freedom. He argued that despite England having thirty religions, they all coexisted peacefully something that he considered impossible to happen in France. His use this to criticize France in for tolerating royal absolutism, lack of freedom of thought and religious tolerance. Philosophers criticizing royal absolutism like him demonstrated the dissatisfaction among middle-class. Many people considered Voltaire a humorous writer, which made his work very popular and therefore most influential. He used both Candide and Ignorant philosopher works to challenge the absence of religious intolerance. For instanc e, he argued in ignorant philosopher, that many atrocities have been committed because of religion such as catholic. As a result, he called for philosophers to look back at many of these atrocities to demand for religious toleration (Spielvogel 520). Social influence Through establishment of salons, philosophers exchanged different types of knowledge in places that did not have religious or political leaders influence. These social gatherings played an important role because in their time the government exercised a lot of censorship. Therefore, within these salons, philosophers could discuss ideas that they would otherwise hesitate to put across. Since they did not have freedom to publish whatever they wanted, they called for freedom of expression. In addition, Salons led by women thinkers helped to empower women in many ways such as raising funds to publish women work. In most case, these Salons meant to shape public opinions in a well-regulated manner. The period also influenced s ocial hierarchy. Philosophers challenged the noblesââ¬â¢ indulgence in special treatments. Its influence on social ranking was not easy because philosophers too enjoyed some special treatments in social places. Those in the Middle-class were elevated in this period as they mixed freely with the nobles in the Salons and other social gatherings. Voltaire was one of the philosophers belonging to the Middle class. Political influence Separation of power that Montesquieu popularized in his analysis of the England constitution is one of the major political influences to western civilization cause by enlightenment. His analysis was influential in political thoughts because it put across the need to have some checks and balance achieved through this kind of separation (Spielvogel 518).Advertising We will write a custom research paper sample on How Did the Age of Enlightenment Influence Western Civilization specifically for you for only $16.05 $11/page Learn More In his argument he was convinced that a political system like that of England with separate powers of the judiciary, legislature and executive, which ensured each arm is controlled, was essential to have a state that has greatest security and freedom. His work was later translated into English. This enabled American philosophers like James Madison, Benjamin Franklin, John Adams, Thomas Jefferson, and Alexander Hamilton to read the work. As a result, they included its philosophy in the American constitution. There was also believe that nature did not make people evil but rather its due to poor legislations, bad models and education (Perry 254).Philosophers like Locke trough their work argued that human mind is like a blank slate at birth. This inferred that people were not automatically sinners, since they knew nothing at birth. Environment was therefore a decisive force in the development of intelligence or character. According to his argument, a new society can develop through tra nsforming the environment and focusing people to the right kind of influences. These new environment could be developed by creating new laws that were based on reasons. He argued that a government could only be legitimate if the governed agree in what he termed as a social contract. Rebellion to him was inevitable in absence of such a contract (Staufenberg 210). Later Enlightenment This took place in the late 1760s, as philosophers who had matured in the age of enlightenment furthered the beliefs of their ancestors. One such philosopher was Baron Paul dââ¬â¢Holbach. He advocated for stringent atheism and materialism (Spielvogel 522). He argued that God was not important for people to live a moral life. In his argument, he called for morality that stems from knowledge that, what a person does in this world is punishable here and not in the other world. Another influential philosopher of the time is Jean-Jacques Rousseau. He considered the laws as impinging on peopleââ¬â¢s freed om and argued for a general free will. To him, to achieve people freethinking everybody must follow what is best for all. He challenged the belief that parliament should make laws for everybody based on his argument for involvement of each individual in creating these laws. His work therefore influenced the adaptation of true democracy. Rousseauââ¬â¢s work that argued a woman should be educated on domains that she naturally performs her duties like nurturing raised debate on gender issues (Spielvogel 523). Some philosophers considered Women in the enlightenment period as naturally inferior to men and male domination over them was widely accepted. For instance, they considered roles played by women, as resulting from their biological composition. Therefore, many male writers disregarded women intellectuals arguing that male were naturally superior. Some philosophers like Diderot though argued that there was little difference between the two.Advertising Looking for research paper on ancient history? Let's see if we can help you! During their time, there was a lot of inequality between social classes. Consequently, as they traversed the world, they learnt a lot about nature and used their work, to influence public opinions. They challenged existence of religious intolerance, royal absolutism, and absence of freedom of thought. Since most of them were from France these atrocities were common. They considered the elites in power and church doctrines especially those of Catholics as the main perpetrators of these atrocities. They proposed various solutions to address these inequalities. More so, philosophers who had grown in this period extended in their own arguments the knowledge of their predecessors. For instance, we can view participation democracy that Rousseau proposed as a way of extending the separation of power suggested by Montesquieu. Perry, Marvin. Western Civilization: A Brief History. Forestry Jobs, Careers, and Employment
Forestry Jobs, Careers, and Employment According to the Bureau of Labor Statistics, the largest employers of forestry personnel are the state and federal governments. However, the government is not the only source for forestry employment. The forest products industry is a very large employer and routinely hires foresters, forestry technicians and forestry workers throughout the United States and Canada. They usually hire foresters to work on company lands or to purchase wood for their mills. There are also forestry consultants. You may get your first start as an employee of a large consulting forestry firm who generally works for anyone needing forestry assistance. They do it all, either for a flat fee or a percentage of the sale of timber. Becoming a Forester A professional forester has a minimum of a Bachelor of Science (BS) degree in forestry. This degree has to be earned at an accredited forestry school and is usually a minimum entry-level requirement for becoming either a registered or licensed forester in many states, or to become a Certified Forester by the Society of American Foresters (SAF). Foresters are being trained and hired all over the world. Much of what a forester learns is in addition to formal training (see more on what a forester needs to know). Foresters spend considerable time outdoors the first years of their careers. Typical entry-level responsibilities might include measuring and grading trees, evaluating insect outbreaks, conducting land surveys, working in an urban park, evaluating water quality, fighting wildfires, managing prescribed fires, laying out a road system, planting seedlings, and planningà recreational use of forestlands. Duties of a Forester Many foresters manage forested property or purchase timber from timbered lands. An industrial forester may procure timber from private landowners. Doing this entails contacting local forest owners, quantifying the inventory, and appraising the timbers worth. A forester may have to deal with loggers, aid in road layout, and make sure the work meets landowner requirements. He also must deal with state and federal environmental specifications to qualify for types of cost-share practices or maintain appropriate site quality. Foresters who work for state and federal governments manage public forests and parks and also work with private landowners to protect and manage forest land outside of the public domain. They may also design campgrounds and recreational areas. A consulting forester hangs up his own shingle and privately assists people and organizations that need forestry help (see more on what a forester does). After several years of on-the-ground experience and crew supervision, foresters typically advance to preparing reports, public relations, and managing budgets. Many foresters become top executives in public agencies, conservation organizations, and corporations. Others become consultants offering specific forestry services and skills that they develop as they gain experience and knowledge. The Forestry Technician Generally working under the direction of a professional forester,à forestry techniciansà compile data on the characteristics of forest land tracts such as size, content, and condition. These workers travel throughà sections of forest to gather basic information such as species and the population of trees, disease and insect damage, tree seedling mortality, and conditions that may cause fire danger.ââ¬â¹ A technician normally has completed a two-year degree in forest technology from aà SAF recognized forestry technical school. They generally collect the information used to make forest resource decisions. Technical career advancement and ultimate salary levels are usually less than for foresters, however, technicians often have the opportunity to work more in the field than behind a desk. Forest and Logging Workers Theà BLS Occupational Outlook Handbookà defines a forestry worker as less skilled workers who perform a variety of tasks to reforest and conserve timberlands and maintain forest facilities such as roads and campsites. The forest worker is usually the hands-on employee that facilitates first-line maintenance and protecting of the forest. A sample of activities usually performed by a forest or logging worker is listed as follows: Tree plantingà and reforestationPrescribed burning and fire fighting Timber stand improvement includingà pesticide application Boundaryà line maintenance Timber cuttingà and loggingPark and trail maintenance Most forestry and logging workers develop their skills through on-the-job training. Instruction comes primarily from experienced workers. Many associations give special training, particularly for workers training to operate large, expensive machinery and equipment. Safety training is a vital part of instruction for all forestry and logging workers. Forestry and logging occupations are physically demanding. Most forestry and logging workers often do work outdoors in all kinds of weather, sometimes in isolated areas. Most logging occupations involve lifting, climbing, and other strenuous activities. Loggers work under unusually hazardous conditions. Falling trees and branches are a constant threat and so are the dangers associated with log handling operations and use of sawing equipment. Over long periods of time, hearing may be impaired by high noise levels of logging and harvesting equipment. Experience, exercise of caution, and use of proper safety measures and equipment - such as hardhats, eye and hearing protection, safety clothing, boots, andà fire sheltersà - are extremely important to avoid injury. Can we ever know the true level of crime Essay Example | Topics and Well Written Essays - 2750 words
Can we ever know the true level of crime - Essay Example However this seems to be an on-going tale which does not find any end at all. Wherever there is crime, there is punishment and this is because crime has its specific ramifications if understood in the most apt manner. One must understand that punishment and crime are inter-related and hence the former is something which shall directly or indirectly affect an individual within the moral and ethical concepts. The true level of crime must be ascertained before one can suggest where the ramifications and consequences could be deciphered. This paper discusses how crime is a deterrent to the different societies of the world and that its extent cannot be gauged in an easy way. An effort has been made to find out the true level of crime as it happens within the different terrains of the society and for that all-out measures are in place to tackle this menace from its roots.
